Australian Privacy Policy

This policy contains information about the collection, use and disclosure of personal information by Frucor Beverages Limited and Frucor Beverages Group Limited (together "Frucor Beverages", "we" or "us"). This policy applies to our acts and practices in Australia and any other acts and practices to which the Privacy Act 1988 (the "Act"). The Website includes all of our web pages accessible from www.frucor.com.au, www.vraw.com.au, www.v-energy.com.au, and www.mizone.com.au, (the "Website").

In this policy, "personal information" means information or an opinion (including information or an opinion forming part of a database), whether true or not, and whether recorded in a material form or not, about an individual whose identity is apparent, or can reasonably be ascertained, from the information or opinion.

This Policy does not apply to acts and practices of a Frucor Beverages entity which relates directly to the employee records of that Frucor Beverage entity's current and former employees.

This policy is based on the principle that your personal information will not be shared other than in accordance with this policy, with your permission or where sharing is otherwise permitted under the Act.

What information do we collect?

Generally, we collect information for the following purposes:

to sell and distribute our products and merchandise;
to consider making offers of employment or engagement;

to build relationships with and work successfully with customers, distributors and suppliers;
for consumer research;

We generally collect your personal information directly from you. For example, we may collect personal information about you when you deal with us over the telephone, send us correspondence (whether by letter, fax or email) subscribe electronically to our publications or when you have contact with us in person.

Generally, the type of personal information we collect may include your name, mailing address, telephone number and e-mail address.

There may be occasions when we need to source personal information about you from a third party. For example, we may collect personal information from a company for which you work, other organisations with which you have any dealings, a credit reporting agency, an information service provider or from a publicly maintained record.

The Website

Personal information provided through voluntary submission (ie application for current vacancies, sponsorship and general enquiries);
Other personal information provided by users through any other method;
Personal information collected by us through click tracking in relation to your use of the Website, including the content you access;
Aggregated data, which tracks traffic to the Website but does not relate to you personally;
Cookies, which are pieces of information transferred to your computer hard drive for record keeping (such as your preferences on the Website).

Failure to provide necessary personal information when requested may result in certain submissions by you not being successful. The personal information you provide will be used to evaluate and/or respond to your submission only. Any personal information that we collect from you will not otherwise be sold or swapped to any third parties.

What do we use personal information for?

General

The personal information collected and held by us may be used for our operations, for providing services, for the promotion and marketing of our business and services and for consumer research.

Personal information is used for the primary purpose for which it is collected, and for other purposes which you consent to or which are permitted without your consent under the Act. We may also use and disclose personal information for purposes related or ancillary to the primary purpose for which it was collected.

Website

Unless you agree otherwise, any personal details that you provide to us as a result of accessing the Website and sending us emails will only be used for the purpose of dealing with your request or enquiry or any other purpose referred to in this policy.

Disclosing personal Information

We may disclose personal information:

to our related bodies corporate;
to our employees and contractors for the purpose of them performing services for Frucor Beverages. Our contractors may include, for example, information technology and telecommunications providers or professional advisors including accountants, auditors and lawyers), credit reporting and fraud checking agencies, insurers, human resources consultants and credit providers;
to courts, law enforcement agencies and others where required to do so by law or where disclosure is otherwise permitted under the Act.

Otherwise, Frucor Beverages' policy is not to disclose any personal information to any third party except with consent or where we are permitted by law to do so.

Applications

If you submit a resume to us then we may disclose the resume to related companies and to contractors (see "Disclosing Personal Information" above). Frucor Beverages will only make such disclosures for the purpose of us and our related companies considering your application. We and our related companies may keep your resume on file indefinitely for that purpose.

Other people's information which you provide to us

If you provide personal information to us about someone else (such as one of your directors or employees or someone with whom you have dealings) you must ensure that you are entitled to disclose that information to us and that, without us taking any further steps required by privacy laws, we may collect, use and disclose such information for the purposes described above.

For example, you should take reasonable steps to ensure the individual concerned is aware of the various matters detailed in this policy as those matters relate to that individual, including our identity, how to contact us, our purposes of collection, our information disclosure practices, the individual's right to obtain access to the information and the consequences for the individual if the information is not provided.

Email Security

In line with our policy and email security, any emails that you send may be automatically scanned, which could result in certain attachments and styles of message being automatically blocked. Our IT administrators may have access to your emails in order to authorise the content. This is done purely for IT security purposes and our IT administrators will not access the content of your emails once this process is complete.

Security of Information

You should be aware that the internet is not a secure environment. However, We protect any personal information that we hold from misuse and loss. We also protect it from unauthorised access, modification and disclosure.

Your personal information may be stored either in hard copy documents or as electronic data in Frucor Beverages' software or systems.

We maintain physical security over our paper and electronic data stores and premises, such as locks and security systems. We also maintain computer and network security; for example, we use firewalls (security measures for the Internet) and other security systems such as user identifiers and passwords to control access to our computer system.

Accessing and Updating Personal Information

We will, on request, provide you with access to the personal information we hold about you unless there is an exception which applies under the Privacy Act such as where we have a legal duty of confidentiality or non-disclosure as mentioned above.

Your request to obtain access will be dealt with in a reasonable time. Frucor Beverages may recover from you its reasonable cost of providing you with access.

If we refuse to provide you with access to the information, we will provide you with reasons for the refusal and inform you of any exceptions relied upon under the Privacy Act.

We take reasonable steps to ensure that your personal information is accurate, complete, and up-to-date whenever we collect or use it.

If any of the personal information we hold about you is inaccurate, incomplete or out-of-date, please contact us immediately and we will take reasonable steps to correct this information or, if necessary, we will discuss alternative action with you.

Transborder

Any personal information that you provide to us will be held by us at Frucor Beverages (Australia) Pty Limited in Sydney, Australia. We may transfer your personal information to Frucor Beverages Limited in Auckland, New Zealand to achieve the purpose for which the information was provided. We will only transfer your personal information to foreign countries with your express or implied consent or where we are satisfied that we may do so consistently with the Act.
